Terms of Service

These Terms of Service govern your use of the Formosus desktop application, our website, and any related services we provide. By installing the application or creating an account, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, do not install or use Formosus. We may update these terms at any time by posting a revised version on this page. Your continued use of Formosus after any change constitutes acceptance of the updated terms.

Eligibility

You must be at least 13 years of age to use Formosus. By creating an account, you represent that you meet this requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf. We do not knowingly allow accounts to be created by persons under 13.

Acceptable use

You may use Formosus to generate wallpapers for your own personal, private desktop use, and for commercial purposes. You retain ownership of the wallpapers you generate.

You may not redistribute generated wallpapers as usable files — for example, by uploading them for others to download and install as wallpapers, bundling them into products, or selling them — without our prior written permission. Sharing or showing your wallpapers on social media, in videos, or in any other visual context is explicitly permitted and encouraged.

You may not use Formosus to create content that is illegal, that depicts real identifiable persons without their consent, that infringes the intellectual property rights of others, or that violates the published content policies of our underlying generation providers. You may not attempt to reverse engineer, decompile, or extract the source code of the Formosus application. You may not use automated means to access the service or generate content at a volume that disrupts other users.

Formosus generates content entirely at your direction based on the prompts you provide. You accept full responsibility and liability for the prompts you submit and the content produced from them. We are not responsible for any wallpaper you generate, and we expressly disclaim any liability arising from content produced at your request.

We reserve the right to suspend or terminate accounts that violate these restrictions.

Intellectual property

Formosus, including its name, logo, interface design, and underlying software, is the exclusive property of Formosus and its licensors. These terms do not grant you any license to our intellectual property beyond the limited right to use the application for its intended purpose. All rights not expressly granted are reserved.

Generated content

The wallpapers generated by Formosus are unique to each prompt you provide. Generation results reflect your creative input — variations in style, detail, and fidelity are inherent to AI-generated content and not a defect of the service. This includes cases where a generated video contains little or no visible motion.

Credits and purchases

Formosus operates on a credit-based model. Credits are purchased through your account and consumed each time you generate a wallpaper. Credits do not expire and remain associated with your account for as long as your account remains active. All purchases are processed by Paddle, our payment provider, and are non-refundable except where required by applicable law. If a generation fails due to a technical error on our side, the credits consumed by that generation will be returned to your account. We reserve the right to adjust credit pricing for future purchases; credits already purchased are not affected by pricing changes.

Service availability

We work to keep Formosus available at all times, but the service is provided on an "as is" and "as available" basis without warranty of any kind, express or implied. We may perform maintenance, update or remove features, or temporarily suspend generation services without prior notice. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service, including lost profits, lost data, or business interruption. Where liability cannot be excluded by law, our total aggregate liability to you is limited to the amount you paid us in the twelve months preceding the claim.

Termination

You may stop using Formosus at any time. To close your account, contact us at the address on our Contact page. Upon voluntary account closure, any remaining unused credits are forfeit. We do not issue refunds for unused credits except where required by applicable law.

We may suspend or terminate your account immediately and without notice if you violate these terms, engage in fraudulent payment activity, or if we are required to do so by law. In the case of termination for cause, remaining credits are forfeit immediately and no refund will be issued.

Disputes and governing law

Before initiating any formal legal proceeding, you agree to contact us at the address on our Contact page and give us 30 days to attempt to resolve the dispute informally. If the dispute cannot be resolved informally, it shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions. You agree that any legal action arising out of or relating to these terms shall be brought exclusively in the courts located in the Republic of Kazakhstan, and you consent to the personal jurisdiction of those courts. To the fullest extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration against Formosus.
